These General Terms and Conditions regulate the purchase of goods through the online store and in physical retail outlets of Back to Blu d.o.o. The rules are harmonised with the Civil Obligations Act and the Consumer Protection Act.

 

1. Definitions

A Consumer is any natural person who enters into a legal transaction outside his or her trade, business, craft or professional activity.

A Business Customer is a legal entity or a natural person acting within the scope of his or her activity.

Goods are items placed on the market by Back to Blu.

 

2. Prices and product information

Prices are expressed in EUR and include VAT unless otherwise specified. Reasonable variations in colours and textures are possible due to the nature of textiles. Delivery costs and any additional charges are displayed before purchase is completed.

 

3. Order and conclusion of contract

By placing an order, the Consumer makes an offer. The contract is concluded when Back to Blu sends an order confirmation by e-mail. If the order cannot be processed, the paid amount will be refunded.

 

4. Payment

Accepted payment methods: cards. Payments are processed via CorvusPay. Security information is available at checkout.

 

5. Delivery and transfer of risk

Delivery options, timeframes and costs are displayed at checkout. Risk passes to the Consumer when he or she takes possession of the goods, or when they are taken over by a person designated by the Consumer who is not the carrier. In the case of partial deliveries, risk passes for each delivered part.

 

5a. Free shipping conditions

Back to Blu offers free shipping for orders over €250 delivered within the European Union. Due to significantly higher courier and logistics costs, this benefit does not apply to deliveries to Cyprus and Malta, for which standard shipping rates apply regardless of order value.

Free shipping is applied automatically at checkout when the conditions above are met. Shipping rates are weight-based, and all applicable costs for non-eligible destinations are displayed before the purchase is completed.

 

6. Retention and disposal of packaging

At the Consumer’s request, Back to Blu shall retain and dispose of packaging in accordance with applicable regulations.

 

7. Customer telephone line

If a customer telephone line is established for contracts, the call will be charged at the operator’s basic tariff.

 

8. Consumer complaints

The Consumer may submit a written complaint by e-mail or post. Back to Blu will confirm receipt of the e-mail without delay and respond in writing within 15 days of receipt of the complaint. Complaint records are kept for 1 year on a durable medium.

9. Right of unilateral termination for distance and off-premises contracts

The Consumer has the right to terminate the contract without giving any reason within 14 days. The period begins:

  • on the day the Consumer or a third party designated by the Consumer, who is not the carrier, takes possession of the goods
  • for multiple items in one order delivered separately, on the day of receipt of the last item
  • for regular deliveries over a period, on the day of receipt of the first delivery.

If the Consumer has not been informed of the right to terminate, the right expires 12 months after the end of the basic period. If notice is subsequently given within that period, the right expires 14 days after receipt of the notice.

How to exercise the right: the Consumer must submit an unambiguous statement of termination before the expiry of the period, using the form in the Annex or in another clear way, by e-mail or post. If termination is sent by e-mail, Back to Blu will confirm receipt on a durable medium without delay.

 

Effects of termination:

Refund of all payments received, including the cheapest offered standard delivery, without delay and no later than 14 days from receipt of the termination notice.

The refund may be withheld until the goods are returned or proof is provided that they have been sent back, unless collection has been offered.

Refunds will be made using the same means of payment, unless the Consumer expressly agrees otherwise, and without any additional costs to the Consumer.

 

Consumer obligations:

  • Return the goods without delay, no later than 14 days from the notice of termination, unless collection has been offered.
  • Bear the direct cost of returning the goods, unless Back to Blu has agreed to bear these costs or failed to inform the Consumer of the obligation to bear them.
  • If the goods cannot normally be returned by post due to their nature, Back to Blu shall collect the goods at its own expense.

The Consumer is liable for any reduction in the value of the goods resulting from handling other than what is necessary to establish their nature, characteristics and functionality. If the Consumer has not been informed of the right to terminate, he or she will not be liable for reduction in value.

Exceptions to the right of termination: there is no right of termination for, for example, goods made to the Consumer’s specification or clearly personalised, perishable goods, sealed goods not suitable for return for health or hygiene reasons if unsealed, goods inseparably mixed with others, newspapers and magazines without subscription, digital content not supplied on a tangible medium once performance has begun with the express consent and confirmation of loss of the right, and other cases prescribed by law.

 

10. In-store purchases and voluntary return

For in-store purchases there is no statutory right of return without defect. Returns are possible only if advertised as a voluntary benefit. Statutory rights in case of defect remain unaffected.

 

11. Liability for material defects

Back to Blu is liable for material defects that existed at the time of transfer of risk to the buyer and for those that appear later if they originate from a cause prior to transfer of risk. A defect exists when the goods lack the properties necessary for regular or special use known to the seller, do not correspond to the sample or model, lack the usual properties that can reasonably be expected, or are incorrectly assembled where assembly is part of the contract or instructions are incorrect.

Notification periods and liability:

  • The Consumer is not obliged to inspect the goods upon receipt, but must report visible defects within 2 months of becoming aware of them, and no later than 2 years from the transfer of risk.
  • Business Customers must inspect and report visible defects without delay and no later than 8 days, and hidden defects immediately upon discovery.
  • Liability ceases after 2 years for Consumers and 6 months for business contracts, unless otherwise agreed or prescribed. For second-hand goods, a period of 1 year may be agreed for Consumers.

Presumption in the first 6 months: if a defect appears within 6 months of the transfer of risk to the Consumer, it is presumed to have existed at that time, unless Back to Blu proves otherwise or this does not follow from the nature of the goods or the defect. The cost of expert assessment is borne by Back to Blu during this period if it claims the defect did not exist. After 6 to 24 months, the cost is borne by the party according to the outcome of the assessment.

Buyer’s rights in case of defect:

  • rectification of the defect
  • replacement of the goods
  • price reduction
  • termination of the contract with a refund, if the defect is not minor

The costs of rectification or replacement are borne by Back to Blu, including transport and delivery. If rectification or replacement is not possible or not carried out within a reasonable time, the buyer may request a price reduction or termination and compensation for damages under general rules.

Conditions for termination: the buyer may terminate after allowing an appropriate additional period, unless Back to Blu has stated that it will not perform, if it is obvious that it cannot perform even within the additional period, or when the buyer cannot achieve the purpose of the contract due to delay.

 

12. Warranty, if provided

A commercial warranty exists only if expressly given by the manufacturer or Back to Blu and applies in addition to statutory rights arising from liability for defects. During the warranty period diagnostics are free of charge. Minor repairs extend, and replacement or substantial repair restart the warranty period for the whole or the replaced part.

 

13. Return of goods and logistics

Send goods to: Back to Blu d.o.o., Varaždinska cesta 34/1, 10360 Sesvete, Croatia. Please enclose proof of purchase and, if terminating, the completed form. We recommend sending with tracking.

 

14. Intellectual property

Trademarks, designs, texts and images are the property of Back to Blu or licensed. Use without consent is prohibited.

 

15. Force majeure

We shall not be liable for non-performance or delay caused by events beyond reasonable control, subject to reasonable mitigation of consequences.

 

16. Personal data

The processing of personal data is governed by the Privacy Policy available at the link.

 

17. Dispute resolution

Please contact us at admin@backtoblu.com. Applicable mandatory consumer protection rules and the jurisdiction of Croatian authorities apply.

 

18. Governing law and jurisdiction

The law of the Republic of Croatia applies. The competent courts in Croatia have jurisdiction, subject to mandatory consumer rights to initiate proceedings under applicable law.

 

19. Amendments

These Terms may be updated. The version valid at the time of your order applies to that order. The current version is always available on this page.
